A few weeks ago, a Consumerism Commentary reader asked me on Facebook whether it would be a good idea to purchase shares of Facebook at $48 a piece. I do not give stock buying advice, but I mentioned that shares had recently been sold for $44.10 on the secondary market, so if someone were to accept an offer to buy shares at $48, they’d have to believe that the value had increased since the auction.

Interest in buying shares of Facebook has increased as rumors about the company’s going public continued, and when Facebook finally filed for its initial public offering (IPO) in February, shareholders (mostly company employees and investors willing to buy in the secondary market) celebrated. The company now plans to become a public company on May 18, though that date is somewhat flexible. Also flexible is the target range for the initial share price when the company goes public.

FacebookFacebook has set its open share price to be between $28 and $35. With the shares Facebook’s famed CEO, Mark Zuckerberg, plans to sell at the opening, he will personally cash in $1 billion, while the company raises at least $12 billion through new shares. The total valuation of the company could lie anywhere between $75 and $98 billion, according to CNN Money.

There is no doubt that Facebook is the biggest success story in technology in this century so far. Those who invested early, friends of Zuckerberg since the beginnings of the company and employees who received significant amounts of stock options, stand to be able to cash in their shares and retire pleasantly wealthy. Those buying shares on or after May 18 may be able to catch a star continuing to rise.

Google continued to perform well after its IPO, for example. Investors were concerned about overpaying for Google shares at about $100 around the time of that company’s initial public offering, but today’s price is over $600. Facebook’s shares will be sold at a price-to-earnings ratio of 99, higher than almost all companies in the S&P 500 index, making the investment seem to be at a high risk for its price to fall. Both Zynga and Groupon, after going public last year, are now trading below their initial share prices.

Update: Although average individual investors have traditionally had limited access to initial public offerings, Facebook, following a trend of other technology companies going public, will likely be opening its IPO up to E*Trade. If you have an E*Trade account in good standing, you can indicate how many shares of Facebook you would like and the maximum price you’d like to pay. E*Trade will distribute the shares it receives among its individual investors who bid high enough.

In just a short period of time, Consumerism Commentary will be entering its tenth year of existence. The site’s ninth anniversary is approaching, and I’ve been involved with the website longer than I’ve been involved with any other commitment in my life. Jobs and relationships have come and gone, but Consumerism Commentary remains.

I started the website in an effort to track my personal finances at a time when I was struggling financially, though I had already started a new path towards financial independence. Thanks to the readers early on who believed the website offered something unique, the growth of the community has been nothing short of amazing. Consumerism Commentary has changed character a little bit from those early years, when a blog was more about short, quick chronological updates and about sharing links to other interesting things found online. Last year, I solidified the website’s vision, mission, and purpose. While the owner of the site is now different, not much else has changed, and there are no plans to change anything in the near future, except for perhaps a more professional-looking logo and site design.

Thanks to all the readers who have continued to visit this website since 2003, our fans and friends on Facebook, and particularly those who continue to participate in discussions today. Thanks also to all the colleagues who have offered their advice and encouragement, and a big thanks to Jay Frosting (also known as Bryan J Busch) and Tom Dziubek who have held down the podcast fort for several years.

And if you’ve encountered any technical issues with the website recently, please continue to bear with me as the technical team continues to work out the bugs.

There are five types of purchases — well, more than five but these five are big — you should never put on your credit card. Every purchase you make is tracked by your credit card issuers and can be used against you if the companies decide you’re a higher risk than they originally thought. And they can change your risk profile based solely on the types of stores you visit.

Adrian from 7 Million 7 Years talks about how it may be hard to believe that someone in New York struggles on an income of $350,000 a year, but he understands the perspective. Andrew Schiff, who works for a brokerage firm, earns this salary but “feels stuck” according to an article in the Wall Street Journal.

Mike, the Oblivious Investor, argues that even an individual with a reduced life expectancy should wait as long as possible before collecting payments from Social Security. There are some specific circumstances in which it might be beneficial to claim Social Security benefits early, however. Mike explains within the article.

Just when you thought it was safe, Bank of America and other large, national banks, are still finding ways to charge customers new fees. Only a few months ago, word of a new $5 monthly fee for debit card users sent Bank of America customers into a frenzy, threatening to move money away from the financial giant. Bank Transfer Day was largely a success, despite the complicated process of switching banks in today’s automated banking environment.

Hundreds of thousands of customers enrolled in credit unions, smaller organizations that are generally more consumer- and community-friendly than national institutions. Fees like Bank of America’s $5 debit card fee hit mainstream news outlets, bringing personal finance into the consciousness of the public once again. Bank of America eventually dropped its proposal for the new fee, but the bank didn’t stop looking for more methods of extracting funds out of its customers.

Bank of AmericaFor the last generation, customers have grown accustomed to free or mostly-free checking and savings. These are considered deposit accounts. Depositing your money with a bank is more beneficial for the bank than for the customer. Doing business with a bank does the company a favor. The institutions should be paying customers for the banks’ benefit of holding the customers’ money. Sometimes banks do pay consumers, through interest on savings accounts, which as most people know have been at pathetic rates for the last few years.

With money on deposit, banks can go out and offer loans to businesses and individuals, earning money on the interest charged on those loans. That’s where banks should make money from their customers. Savings and checking customers are doing banks a favor.

Lately, the problem has been that banks aren’t making as much money from lending as they had previously, and shareholders demand consistently growing profits. That pressure results in even more fees. And banks are now counting on the fact that last year’s outrage has subsided, and the public is now willing to live with the idea that basic banking is not free. Additionally, it’s fair to say that the cost for a bank to manage checking and savings accounts may have increased, due to research and development into technology to provide all the banking conveniences (online access, mobile apps, person-to-person payments, etc.) that consumers have come to expect, although one could argue the lowered reliance on tellers and live customer services representatives should offset that cost.

Furthermore, the latest round of fees are designed to hurt lower income households more than those with higher net worth amounts. It’s been true in investing for a while that the better rates and lower fees are available to those with higher balances. This is due to the attempt to convince customers to invest as much money as possible with any one particular institution or brokerage. The same is true with fees; the more money you have, the more leverage you have to demand lower costs for the services you buy.

This leaves low-income families in a tough spot. If you can’t maintain a minimum balance in your checking account, a monthly fee will reduce that low balance even further, possibly even below zero, so you end up owing money to the bank or the bank decides to close your account. While the balance minimums encourage customers to leave more of their money with one institution, not all customers have more money to deposit.

Here are a few recent examples of how the latest round of new fees from big banks penalize those without the means to deposit more.

  • Some Wells Fargo customers have been subject to a new $15 monthly fee if unable to maintain a $7,500 balance. And they’ve recently changed policies to prevent customers from suing the bank or being part of a class-action lawsuit.
  • Citibank increased its minimum balance to avoid a $20 monthly fee from $6,000 to $15,000.
  • Bank of America is testing new monthly fees of $6 to $25 in three states (Arizona, Georgia and Massachusetts).

At the same time, an informal poll of fans of Consumerism Commentary on Facebook and followers on Twitter indicates most engaged Consumerism Commentary readers, who generally earn more than the average internet user according to basic demographic research, pay nothing for their checking account, though some are still subject to a minimum balance or enrolling in direct deposit to avoid a fee. Finding free checking is still possible, especially with credit unions, but non-students still need to occasionally jump through hoops with major banks.

New regulations are often cited by the financial industry as the trigger for punishing low-income customers for handing their money to banks for safekeeping and lending. Others see these new fees as a way for banks to increase profits while using regulation as a convenient scapegoat. Of course, opinions on the matter are generally divided along political party lines as well as between industry lobbyists and consumer advocacy groups.

Low-income families might continue to avoid the banking industry, which may be the unstated goal of financial institutions in the first place. Unfortunately, that leaves little choice for low socio-economic status communities other than turning to non-bank financial products, like expensive payday loans and check cashing services. Not only do these communities need better financial role models (education alone will never solve the financial literacy problem), but they need to be guided toward better products and services.

There’s a real market opportunity for better products and services, for smart entrepreneurs who are looking to make a difference. In the mean time, here’s how to close your Bank of America savings or checking account when walking into the branch won’t work for you.

Consumer Privacy Bill of Rights

Last week, the White House released a Consumer Privacy Bill of Rights. This isn’t a law or regulation, but a set of guidelines that could possibly underscore future actions by Congress and enforcement by the Federal Trade Commission. Private, personal information should be private and personal, but when consumers enroll for any type of service, the terms of use of those services often require signing away the rights to this information.

If, for example, you’d like to use Facebook to share photographs with your friends and see what they’ve been doing lately, you must agree to the service’s policies which include the service’s ability to keep your personal data on file and use it to deliver targeted ads and to track the other, non-Facebook websites you visit.

FacebookThe Consumer Privacy Bill of Rights aims to give consumers more control of their personal information. Some of the guidelines are common sense, and many companies already follow these guidelines or come close. Codifying these principles is a positive step towards making consumers aware of expectations for the companies they interact with every day, like social media websites, banks and other financial institutions, and retailers.

Here are the main points:

Consumers have a right to exercise control over what personal data companies collect from them and how they use it.

  • Companies should give consumers choices about how companies collect, use, and share personal data.
  • The ability to make these choices should be easy to use and easily accessible.
  • The ability to change these choices after initially selecting them should be just as easy to use and accessible.

Consumers have a right to easily understandable and accessible information about privacy and security practices.

  • Companies should clearly explain how personal information is collected and used internally and with third-parties.
  • Companies should clearly define the policy for deleting private customer data.

Consumers have a right to expect that companies will collect, use, and disclose personal data in ways that are consistent with the context in which consumers provide the data.

  • Companies should not provide consumers’ personal information to third parties who will use that information for a different than it was intended. For example, if I, as a Facebook user, “like” the band Pink Floyd, I shouldn’t begin receiving emails from Amazon.com advertising Pink Floyd albums.
  • Companies have a right to ask whether any particular customer would consent to this type of information sharing.

Consumers have a right to secure and responsible handling of personal data.

  • From the text of the Privacy Bill of Rights: “Companies should assess the privacy and security risks associated with their personal data practices and maintain reasonable safeguards to control risks such as loss; unauthorized access, use, destruction, or modification; and improper disclosure.”

Consumers have a right to access and correct personal data in usable formats, in a manner that is appropriate to the sensitivity of the data and the risk of adverse consequences to consumers if the data is inaccurate.

  • Companies should ensure the data they collect is accurate and current.
  • Consumers should be able to review and correct stored information.
  • Consumers should be able to request stored information be deleted.

Consumers have a right to reasonable limits on the personal data that companies collect and retain.

  • Companies shouldn’t collect more information than necessary.
  • Companies should securely dispose of information when no longer needed.

Consumers have a right to have personal data handled by companies with appropriate measures in place to assure they adhere to the Consumer Privacy Bill of Rights.

  • Consumers should expect companies to follow these guidelines.
  • Both companies and consumers should expect the employees of companies collecting users’ personal information to follow these guidelines.
